    Yes. If you own real estate jointly and cannot agree with the other owner(s), you have the right to petition for a court-ordered sale or division.

  • Does partition always mean selling the property?

    No. In some cases, the property can be physically divided between the owners—this is called “partition in kind.” If that’s not practical, the court may order a sale.

  • Do all co-owners need to agree to file a partition?

    No. One co-owner can initiate the process even without consent from the others, though collaboration can make the process quicker and less costly.
